Terms of Use.

1. Acceptance of these Terms

These Terms of Use ("Terms") form a binding legal agreement between you ("you," "user") and Advanced Ministries LLC ("Advanced Ministries," "we," "us," "our"), the operator of the website located at nfp.fyi and any associated subdomains, pages, content, tools, quizzes, email communications, and services (collectively, the "Site"). By accessing or using the Site in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not access or use the Site.

2. Educational purpose only, not medical, legal, or professional advice

The Site is an educational resource. All content on the Site, including articles, guides, method comparisons, quizzes, charts, citations, summaries of research, glossary entries, and any responses you receive from the Site, is provided for general informational and educational purposes only. Nothing on the Site is, or is intended to be, medical advice, diagnosis, treatment, prescription, counseling, legal advice, financial advice, theological direction, or any other form of professional advice. No physician–patient, counselor–client, attorney–client, or fiduciary relationship is created by your use of the Site.

Always seek the advice of a qualified physician, clinician, or other licensed professional with any questions you may have regarding a medical condition, fertility, contraception, pregnancy, breastfeeding, mental health, or any other personal matter. Never disregard professional advice, or delay in seeking it, because of something you have read on the Site. Reliance on any information provided by the Site is solely at your own risk.

3. No guarantee of outcomes

Fertility awareness, Natural Family Planning, and related practices vary significantly in effectiveness based on the method, the instruction received, individual physiology, life stage, consistency of use, and many other factors. Effectiveness figures cited on the Site reflect the populations and conditions of the underlying studies and are not predictions or guarantees of any outcome for any individual user. We make no representation or warranty that any method, tool, app, device, or recommendation discussed on the Site will achieve or avoid pregnancy, identify or rule out any medical condition, or produce any other result.

4. Eligibility

The Site is intended for users who are at least 18 years old, or the age of majority in their jurisdiction, whichever is greater. By using the Site you represent and warrant that you meet this requirement and that your use of the Site complies with all applicable laws.

5. Accounts and security

Some features of the Site may require you to create an account or submit information (for example, to take a quiz or receive results by email). You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate information and to promptly notify us of any unauthorized use of your account. We may suspend or terminate accounts at our discretion, including for suspected abuse, security risk, or violation of these Terms.

6. Acceptable use

You agree that you will not, and will not permit any third party to:

• use the Site in violation of any law or regulation;
• use the Site to harass, defame, defraud, or harm any person;
• scrape, crawl, harvest, mirror, frame, or systematically copy any portion of the Site without our prior written consent;
• use the Site or its content to train, fine-tune, evaluate, or otherwise develop any machine-learning model, large language model, or artificial-intelligence system, except with our prior written consent;
• reverse engineer, decompile, or attempt to derive the source code or underlying ideas of the Site;
• upload, submit, or transmit any virus, malware, or harmful code;
• attempt to gain unauthorized access to the Site, its servers, or any related systems;
• interfere with or disrupt the integrity, performance, or availability of the Site; or
• misrepresent your identity or affiliation with any person or organization.

7. Intellectual property

All content on the Site, including text, graphics, illustrations, logos, wordmarks, icons, images, audio, video, code, layout, design, selection and arrangement of content, and the "NFPfyi" name and brand, is owned by or licensed to Advanced Ministries LLC and is protected by United States and international copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Site for your personal, non-commercial educational use. All rights not expressly granted are reserved. You may not reproduce, distribute, publicly display, perform, modify, create derivative works of, sell, or commercially exploit any portion of the Site without our prior written permission, except for brief quotations with proper attribution as permitted by fair use.

8. User submissions and feedback

If you send us questions, suggestions, feedback, testimonials, or any other content (each a "Submission"), you grant Advanced Ministries LLC a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display the Submission for any lawful purpose, including improving the Site, in any media now known or later developed, without compensation or attribution to you. You represent and warrant that each Submission is your original work and does not infringe any third-party right.

9. Third-party content, links, and services

The Site may reference or link to third-party websites, studies, products, methods, applications, instructors, or organizations. Such references are provided for educational convenience only and do not constitute an endorsement. We do not control, monitor, verify, or take responsibility for the availability, accuracy, content, products, services, policies, or practices of any third party. Your dealings with any third party are solely between you and that third party.

10. Faith and ethics content

Portions of the Site discuss religious, theological, and ethical perspectives on fertility, marriage, and family planning. These materials reflect the editorial viewpoint of the authors and of Advanced Ministries LLC. They are presented for educational consideration and are not pastoral counseling, spiritual direction, sacramental guidance, or a binding theological opinion. You are encouraged to consult your own pastor, priest, rabbi, imam, or other faith leader regarding personal religious questions.

11. Disclaimers, "AS IS," "AS AVAILABLE"

To the maximum extent permitted by law, the Site and all content, materials, communications, quizzes, results, recommendations, tools, and services made available through the Site are provided strictly on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranty of any kind. Advanced Ministries LLC, its members, managers, officers, employees, contractors, agents, contributors, partners (including The Marriage Group), and licensors (collectively, the "Released Parties") expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including, without limitation, warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, currency, reliability, security, uninterrupted or error-free operation, quiet enjoyment, and any warranties arising from course of dealing, performance, or trade usage.

Without limiting the foregoing, the Released Parties make no warranty or representation that: (a) the Site or any content will meet your requirements or expectations; (b) any information on the Site is accurate, current, complete, or reliable; (c) any method, tool, device, app, or practice discussed on the Site will achieve any particular medical, fertility, reproductive, contraceptive, conceptive, emotional, relational, financial, or spiritual outcome; (d) the Site will be uninterrupted, timely, secure, or free of errors, viruses, or harmful components; or (e) any defect in the Site will be corrected. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the foregoing exclusions apply to the maximum extent permitted by law.

12. Limitation of liability

To the fullest extent permitted by applicable law, in no event shall the Released Parties be liable to you or to any third party for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including, without limitation, damages for loss of profits, revenue, savings, goodwill, data, use, business opportunity, reputation, fertility outcomes (including any unintended pregnancy, failure to conceive, miscarriage, complication of pregnancy or birth, or harm to a child), medical condition, emotional distress, mental anguish, marital or relational harm, spiritual harm, personal injury, property damage, or any other intangible loss arising out of or in connection with: (a) your access to, use of, inability to access, or inability to use the Site; (b) any content, information, advice, or recommendation appearing on the Site; (c) any action you take or fail to take in reliance on the Site; (d) any conduct or content of any third party on the Site or referenced by the Site; or (e) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), product liability, statute, or any other legal theory, and whether or not the Released Parties have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, the aggregate liability of the Released Parties to you for all claims arising out of or relating to these Terms or the Site, whether in contract, tort, or any other theory, will not exceed the greater of (i) the total amounts, if any, that you have paid to Advanced Ministries LLC for access to the Site in the twelve (12) months preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars ($100). The existence of more than one claim will not enlarge this limit. You agree that the limitations in this Section are an essential element of the basis of the bargain between you and Advanced Ministries LLC, and that without them the Site would not be provided to you.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you in part. In such jurisdictions, the liability of the Released Parties is limited to the smallest extent permitted by law. Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited.

13. Assumption of risk

You acknowledge and accept that decisions about fertility, contraception, conception, pregnancy, and reproductive health carry inherent risks that no educational resource can eliminate. You voluntarily assume all risks associated with your use of the Site and your decisions made in connection with that use, and you agree that the Released Parties are not responsible for those decisions or their outcomes.

14. Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, demands, actions, proceedings, liabilities, damages, judgments, settlements, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Site; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; (d) your Submissions; or (e) any decision or action you take in connection with the Site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.

15. Modifications to the Site and Terms

We may modify, suspend, or discontinue the Site or any portion of it at any time, with or without notice. We may also revise these Terms from time to time. The revised Terms will be posted on the Site with an updated effective date. Your continued use of the Site after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, your sole remedy is to stop using the Site.

16. Termination

We may terminate or suspend your access to all or part of the Site at any time, for any reason or no reason, without notice or liability. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

17. Governing law and venue

These Terms and any dispute arising out of or relating to them or to the Site shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict-of-laws principles. You agree that the exclusive jurisdiction and venue for any action not subject to arbitration shall be the state and federal courts located in St. Clair County, Michigan, and you consent to the personal jurisdiction of those courts.

18. Dispute resolution; class-action waiver

You and Advanced Ministries LLC agree to first attempt in good faith to resolve any dispute informally by contacting us at hello@advancedministries.com. If we cannot resolve the dispute within sixty (60) days, either party may pursue the dispute in the courts identified above. To the fullest extent permitted by law, you agree that any dispute will be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You waive any right to a jury trial to the extent permitted by law.

19. Severability and waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, severed from these Terms, and the remaining provisions will continue in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of that provision.

20. Entire agreement

These Terms, together with our Privacy Policy and any other notices posted on the Site, constitute the entire agreement between you and Advanced Ministries LLC regarding the Site and supersede any prior agreements between you and us regarding the Site.
